These Terms and Conditions ("Terms") govern your use of the VividMindsPress website and storytime application ("Service") operated by VividMindsPress ("we," "us," or "our"). By creating an account or using the Service, you agree to these Terms.
Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account. The Service is intended for parents and caregivers to read stories with children. Children should use the Service only under adult supervision through a parent or caregiver's account.
Account Registration
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate information and to keep your account details up to date.
Subscriptions and Billing
Free Plan
We offer a free tier with access to limited content. Free plan features may change over time.
Paid Plans
Paid subscriptions (such as the Family plan) are billed monthly through our payment provider. Prices are displayed at checkout and may change with reasonable notice.
Free Trial
Eligible paid plans may include a 7-day free trial. You will not be charged until the trial period ends unless you cancel before it expires. Trial eligibility is determined at signup.
Cancellation
You may cancel your subscription at any time through your account billing settings. Cancellation takes effect at the end of the current billing period. You will retain access until that date.
Refunds
If you are not satisfied with your paid subscription, contact us at support@vividmindspress.com within 30 days of your first charge for a refund review. Refunds are granted at our discretion except where required by law.
Acceptable Use
You agree not to:
- Share your account credentials with unauthorized parties
- Copy, redistribute, or commercially exploit story content without permission
- Attempt to circumvent access controls or scrape content at scale
- Use the Service for any unlawful purpose
- Upload harmful, abusive, or infringing content
Intellectual Property
All stories, illustrations, characters, trademarks, and platform content are owned by VividMindsPress or our licensors. Your subscription grants a personal, non-transferable license to access content for private, non-commercial family use. You may not reproduce, distribute, or create derivative works from our content except as expressly permitted (such as sharing via our built-in share features).
User Content
If you provide feedback, ratings, or other content through the Service, you grant us a non-exclusive license to use that content to operate and improve the Service.
Third-Party Services
The Service integrates with third-party providers for authentication, payments, hosting, and content delivery. Your use of those services may be subject to their respective terms.
Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR MEET YOUR SPECIFIC EDUCATIONAL OUTCOMES.
VividMindsPress is a reading platform to support family storytime. It is not a substitute for professional educational, medical, or childcare advice.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIVIDMINDSPRESS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.
Termination
We may suspend or terminate your account if you violate these Terms. You may delete your account at any time through account settings. Upon termination, your right to access the Service ends, subject to applicable data retention requirements.
Changes to Terms
We may modify these Terms at any time. Material changes will be posted on this page with an updated date. Continued use of the Service after changes constitutes acceptance.
Governing Law
These Terms are governed by the laws of the United States and the State in which VividMindsPress operates, without regard to conflict of law principles.
